EDITORIAL:
The Federal election has finally been called, and industrial relations is very newsworthy once again. This combined Spring/Summer edition allows us to compare the policies of the two major parties in some depth. We discuss the changes that Labor has proposed, and offer some practical suggestions about what may be able to be done now to prepare for another round of potentially significant industrial relations changes, whatever the result of the election.
For a refreshing alternative to the highly political approach to industrial relations, we also look at the recently launched Charter of Employment Rights. Written by a tripartite committee representing employers, employees and independents and based on international convention and best practice, the Charter offers a balanced approach (recognising the rights of both employers and employees), which can be adopted by individual workplaces as well as providing an alternative national scheme of industrial relations.
Finally, we note some recent cases on restraints on employee conduct post-employment, a vital area for many employers. Preserving confidentiality, retaining staff and protecting business interests following the departure of a key employee can make an enormous difference to a business, and some recent cases suggest the courts will recognise this in appropriate circumstances.
